TERMS AND CONDITIONS FOR CUSTOMERS

These Terms and Conditions ("Terms") govern the use by the customer ("Customer") of the Fixa platform, both in its mobile application version and its web version (fixanow.com), owned by Fixa Global Technologies, S.L.
By registering and using the platform, the Customer declares to have read, understood and fully accepted these Terms and Fixa's Privacy Policy.
1. Identification of the service provider
In compliance with Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE):

2. Nature of the service: Fixa is an intermediation platform
Fixa is a technology intermediation platform that connects customers with independent self-employed professionals in the home services sector (plumbing, electricity, HVAC, painting, locksmithing, cleaning, pool maintenance, minor renovations and related services).
Fixa does not directly provide repair, installation, maintenance or renovation services. Such services are exclusively provided by the self-employed professionals ("Professionals") registered on the platform, who act on their own behalf and under their sole responsibility.
Fixa qualifies as a provider of intermediation services under the LSSICE.
3. Registration and user account
To use the platform, the Customer must:
- Be at least 18 years old and have legal capacity to contract
- Provide the data requested during registration (name, email, phone and address)
- Provide information that is truthful, accurate and up-to-date
- Diligently safeguard their access credentials
The account is personal and non-transferable. The Customer is responsible for any activity carried out from their account.
Fixa may suspend or cancel the account in cases of fraudulent use, breach of these Terms or prolonged inactivity.
4. How the service works
- The Customer posts a request on the platform, describing the problem and uploading photographs if they wish.
- Fixa shows the request to qualified Professionals available in the area.
- One or more Professionals submit indicative quotes.
- The Customer freely chooses the Professional whose quote they accept.
- Customer and Professional coordinate the visit and the terms of execution through the platform.
- The Professional performs the work.
- The Customer pays the Professional directly the agreed amount.
- The Customer may review and rate the service provided.
5. Prices, quotes and payment
5.1. Indicative quotes. The prices displayed on the platform, as well as the initial quotes provided by Professionals before the on-site visit, are indicative. The final price is agreed between Customer and Professional before the actual start of the work.
5.2. Additional work and materials. If additional work or materials not included in the initial quote are detected during execution, the Professional must inform the Customer and obtain their express consent before continuing.
5.3. Direct payment to the Professional. In the current phase of the service, the Customer pays the Professional directly by the means both parties agree. Fixa does not process payments between the parties at present. Fixa reserves the right to introduce its own payment systems in the future, giving due notice.
5.4. Invoice. The Professional is required to issue an invoice to the Customer for the services rendered, in accordance with applicable tax regulations.
5.5. Travel fee. If the Professional travels to the Customer's home and, after the visit, the work is not agreed, the previously communicated travel fee may be charged.
6. Liability
6.1. Professional's liability. The Professional is the sole responsible party for the correct performance of the service, the quality of the work, the suitability of the materials used, compliance with the applicable technical, sector-specific and safety regulations, and any damages that may arise from the service provided. All Professionals on the platform are required to have current professional civil liability insurance.
6.2. Fixa's liability. Fixa, in its capacity as an intermediation platform, is not liable for the quality, performance, outcome or consequences of the service provided by the Professional, nor for any agreements, promises or commitments the Professional may establish directly with the Customer outside the platform. Fixa's liability is limited to the terms set out in Law 34/2002 (LSSICE) for providers of intermediation services.
6.3. Consumer rights. The provisions of the preceding paragraphs are understood without prejudice to the rights of the Customer-consumer under Royal Legislative Decree 1/2007, Consolidated Text of the General Law for the Defence of Consumers and Users (TRLGDCU), and other applicable regulations, including the statutory guarantee applicable to services and goods. Under no circumstances may these Terms be interpreted as diminishing such rights, which are non-waivable.
7. Cancellation of requests
The Customer may cancel a request at any time before the Professional has travelled, at no cost.
If the Professional has already travelled to the Customer's home, the Customer must pay, where applicable, the travel fee previously communicated.
8. Complaints
8.1. Complaint to Fixa. The Customer may address any complaint relating to the use of the platform or the actions of a Professional to info@fixanow.com. Fixa will mediate between the parties with the aim of reaching a satisfactory solution.
8.2. Official Complaint Form. Fixa has Official Complaint Forms of the Generalitat de Catalunya, with registration number B-655329, available to the Customer. You may request them by email at info@fixanow.com.
8.3. Other channels. The Customer may also address complaints to:
- The Municipal Consumer Information Office (OMIC) of their municipality
- The Catalan Consumer Agency (Agència Catalana del Consum), Gran Via de les Corts Catalanes 587, 08007 Barcelona
- The competent Consumer Arbitration Board
8.4. Online Dispute Resolution. Pursuant to Regulation (EU) 524/2013, the Customer has access to the European Online Dispute Resolution (ODR) Platform, available at: https://ec.europa.eu/consumers/odr
9. Acceptable use of the platform
The Customer undertakes to use the platform in good faith and, in particular, not to:
- Post false or misleading requests
- Use the platform for fraudulent purposes
- Contact Professionals outside the platform in order to circumvent its services
- Post offensive or unlawful content or content that infringes third-party rights
- Submit false reviews or comments
9 bis. User-generated content, moderation and safety
9 bis.1. Zero tolerance. Fixa operates a zero-tolerance policy towards objectionable content and abusive behaviour. The following are strictly prohibited, among others: hate speech or discrimination based on race, ethnicity, gender, religion, sexual orientation, disability or any other protected characteristic; harassment, intimidation or threats; sexually explicit material; graphic violence; spam or fraudulent representations; and sharing third parties' personal data without their consent.
9 bis.2. Moderation. Fixa uses automated filtering to detect and prevent objectionable content. Reports are reviewed by our moderation team within a maximum of 24 hours, and appropriate measures are taken (content removal, warning, suspension or account termination).
9 bis.3. Reporting and blocking. Any user may, directly from the app: (i) report content or behaviour by long-pressing a message or using the options menu on profiles and jobs; and (ii) block any user engaging in abusive behaviour, in which case their content immediately stops being shown. All reports and blocks are forwarded to Fixa's moderation team for review.
10. Use of artificial intelligence
The Customer acknowledges and accepts that Fixa uses artificial intelligence systems to analyse uploaded photographs and offer indicative diagnostics and price ranges. These diagnostics do not replace the professional criterion of the technician, who will assess the problem after the on-site visit.
Fixa may use photographs, messages and conversations for the training and improvement of its artificial intelligence models. The Customer may object to this use at any time in accordance with the Privacy Policy.
11. Intellectual and industrial property
All elements comprising the platform, including but not limited to the "Fixa" trademark, the domain name, the graphic design, the source code, the texts, images, algorithms and artificial intelligence models, are the property of Fixa or its legitimate licensors. Their unauthorised reproduction, distribution, public communication or transformation is prohibited.
12. Data protection
The processing of the Customer's personal data is governed by Fixa's Privacy Policy, which forms an integral part of these Terms and which the Customer declares to be aware of and to accept.
13. Amendments to the Terms
Fixa may amend these Terms for legal, technical, commercial or service improvement reasons. Material amendments will be communicated to the Customer with at least 15 days' notice by email or through the application. Continued use of the service after such communication implies acceptance of the new Terms.
14. Applicable law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute arising from the interpretation or execution of these Terms, the parties submit to the Courts and Tribunals having jurisdiction under the applicable consumer legislation, the Customer-consumer being free to bring proceedings before the courts of their domicile.
