Terms of Service

1. Acceptance of Terms

By accessing or using Fixa (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including customers, professionals, and visitors.

2. About Fixa

Fixa is an online marketplace that connects customers seeking home services with independent professionals. Fixa is not a service provider, employer, or agent of any professional listed on the Platform. Professionals are independent contractors who operate their own businesses. Fixa does not guarantee the quality, timeliness, or outcome of any service performed.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account details
• Keep your password confidential and not share it with others
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. For Customers

As a customer, you may use the Platform to:

• Post service requests describing the work you need
• Receive bids from verified professionals
• Communicate with professionals through the Platform
• Accept bids and schedule service appointments

You are responsible for providing accurate descriptions of the work needed and for making the work site accessible and safe. Posting a job is free of charge.

5. For Professionals

As a professional, you may use the Platform to:

• Create a business profile and list your services
• Bid on jobs posted by customers in your area
• Communicate with customers through the Platform
• Build your reputation through reviews and ratings

By registering as a professional, you represent that you have the necessary qualifications, licenses, and insurance required to perform the services you offer. You are solely responsible for the quality and legality of your work.

6. Bidding & Payments

Fixa operates a bidding system. Professionals submit bids in response to customer job posts. Customers are free to accept or decline any bid.

• Job posting: Free for customers
• Bidding: Professionals may bid under a subscription plan or credit-based system. Active subscriptions or bid credits are required to submit bids.
• Service payments: Payment terms between customer and professional are agreed upon directly. Fixa does not currently process service payments.
• No commissions: Fixa does not take a commission on completed jobs. You keep what you earn.

7. Subscription Plans & Credits

Professionals may choose from the following plans:

• Unlimited Plan: A monthly subscription allowing unlimited bids. Includes a free trial period. The subscription renews automatically unless cancelled.
• Credit Packs: A pay-as-you-go option where you purchase bid credits. Credits do not expire.

All prices are displayed in euros and include applicable taxes. Refund requests for unused subscriptions or credits will be considered on a case-by-case basis.

8. Cancellation & Refunds

You may cancel your subscription at any time. Upon cancellation, your plan benefits will continue until the end of the current billing period. We do not offer automatic refunds for partial billing periods, but you may contact us to request one. Credit packs are non-refundable once purchased.

9. Reviews & Ratings

Customers may leave reviews and ratings for professionals after a completed job. Reviews must be honest and based on genuine experiences. We reserve the right to remove reviews that are fraudulent, defamatory, or violate our community guidelines. Professionals may respond to reviews but may not offer incentives in exchange for positive reviews.

10. Prohibited Conduct

You may not:

• Use the Platform for any illegal purpose
• Submit false, misleading, or fraudulent information
• Impersonate another person or business
• Harass, threaten, or abuse other users
• Circumvent the bidding system or attempt to avoid fees
• Scrape, collect, or store data from the Platform without permission
• Post offensive, harmful, or inappropriate content
• Create multiple accounts to manipulate reviews or bids

11. Intellectual Property

All content on the Platform — including logos, text, graphics, design, and software — is owned by Fixa or its licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written consent. You retain ownership of content you submit (such as your profile and portfolio), but grant Fixa a non-exclusive license to display it on the Platform.

12. Limitation of Liability

Fixa provides the Platform “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, Fixa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to any disputes between customers and professionals regarding service quality, payment, or conduct.

13. Indemnification

You agree to indemnify and hold harmless Fixa, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation first. If resolution cannot be reached, disputes shall be submitted to the courts of Barcelona, Spain. These Terms are governed by and construed in accordance with Spanish law.

15. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
